Contract and Health Guarantee

This contract is the full agreement between the {{customer_wp_user_nicename}} (Buyer) and Beaver Creek Kennel (Seller) of the puppy. This puppy is guaranteed to be in good health to the best of our knowledge at the time of sale, having had a health check by our veterinarian. The Seller will provide the Buyer with a health record of all vaccinations and deworming as well as a veterinarian examination of the puppy.

Buyer agrees to take the puppy to their veterinarian within 10 days from the date of purchase. If the veterinarian believes that the puppy is not healthy and has a life-threatening illness, the buyer must notify the seller within 24 hours of the initial examination and provide us with the reports from your veterinarian to make a claim for a replacement puppy. If there is a problem, our veterinarian will interpret the report and if they concur, then a replacement puppy will be given. This health guarantee is for 30 days from the date of purchase. In this case, you will have the option of replacing the puppy or getting a refund. Transportation charges will not be refunded or paid for the replacement puppy.

If the puppy dies from a suspected congenital defect within 30 days from the date of purchase, an autopsy must be performed at the Buyer’s expense by a veterinarian to determine the cause of death. If our veterinarian agrees that the autopsy shows a congenital defect as the reason for death, the puppy will be replaced at no charge. A written statement from the licensed veterinarian must be provided.

Puppies are sold as pets. The Seller makes no guarantee as to disposition, conformation, size, weight, color, markings, or breeding ability, Buyer understands that this puppy is being purchased as a pet and the Seller cannot guarantee the breeding, hunting, or show ability of any puppy. This guarantee does not cover any expenses due to neutering or spaying, including undescended testes. We do not warrant against any condition caused by carelessness, negligence, or abuse.

The following are NOT covered by this guarantee:

- Reimbursement for veterinary expenses
- Reimbursement for air transport or return
- External parasites, such as ticks, fleas, or ear mites
- Internal parasites, such as intestinal worms, or their effects (almost every puppy has some sort of intestinal worms. Although we have wormed your puppy regularly, it only takes a few days for him/her to pick up another “batch”. This is just a part of puppy hood, which is why a regular worming schedule is recommended.)

The Buyer agrees to provide a life-long commitment, a comfortable environment, prompt medical attention, proper grooming, and responsible care. The Buyer promises to provide a safe environment for the dog. Seller is not responsible or liable for payment on ANY medical, dental, or surgical procedures to maintain the animal’s health or well-being after purchase.

The Seller’s health and the genetic guarantee do not apply if any injury, illness, disease, or fatality develops as a direct result of the dog being overweight, malnourished, or neglected as deemed by our veterinarian. If the puppy is resold to another party other than to who the seller sold the puppy, this guarantee is null and void.

The Seller will not offer a refund or replacement due to buyer’s remorse, difficulty housing a dog and/or change of heart/mind. The Seller does not guarantee the behavior of any dog. However, the Seller will take back any dog purchased from them during its lifetime if the owner is unable or unwilling to care for the dog, but the Seller may not offer a refund. The dog must be returned with all records.

This contract shall be deemed legal and binding between the Seller and Buyer and is under the jurisdiction of the State of Pennsylvania in the County of Lancaster. It is further agreed that should any dispute/arbitration between the Seller and Buyer regarding said puppy that the legal venue shall be in the State of Pennsylvania in the County of Lancaster.

Extended Health Guarantee

As stated above, we do guarantee our puppies from life-threatening health defects for 30 days from the date of purchase. However, if you choose to continue your puppy on the Pawtree Dog Food we will extend the guarantee a full year from the date of birth. You must use our link at http://pawtree.com/beavercreekaussies when ordering the food for us to be able to track you are purchasing the Pawtree Dog Food for the extended contract. We recommend setting up an EZ-Ship order to do this. This extended guarantee is null and void if not purchased using our link to the Pawtree Dog Food website.
